The importance of trademark registration

Trademark is synonymous with the brand name. The trademark can be any word, symbol, name, device or slogan which is identified as a product or business and separates it from others in the market. Once your business is trademarked, if anyone else is using a similar one which can confuse the customers, you can legally protect yourself through the trademark.

In order to be eligible for a trademark, the mark should be separate and should be in use in commerce. If your mark has a commercial standing, the trademark can be obtained by making a good-faith argument in writing where the symbol can be used in the future for commercial purpose. There are four kinds of distinctiveness for trademarks, i.e. suggestive, descriptive, arbitrary or fanciful or generic. The arbitrary and suggestive marks are said to be inherently distinctive where the eligibility is determined by whoever first registers it. The geographic terms, descriptive marks, and personal names should have a secondary meaning in the customer’s minds so that it can be approved as a trademark. One cannot trademark a term which is considered to be generic.
